Risk disclaimer

Draft for review. This text is a starting point written for Havik ProtoLabs. Have it reviewed by a lawyer familiar with the Indian DPDP Act 2023, the IT Act 2000 and, if you serve EU customers, the GDPR, before publishing.
1. We are a software company
Havik ProtoLabs Pvt. Ltd. designs and develops software. We are not a broker, an investment adviser, a portfolio manager, a payment institution or a custodian, and we are not registered or licensed as any of these with SEBI, RBI or any other regulator. Nothing on this site, in our products, or in our communications is investment, financial, legal or tax advice, and nothing is an offer or solicitation to buy or sell any financial instrument.
2. Trading software and signals
Expert Advisors, indicators, signals, copy-trading systems and machine-learning models are tools. They implement rules; they do not remove risk. Trading in foreign exchange, contracts for difference, commodities, indices and crypto-assets is highly speculative and carries a high level of risk, including the loss of all capital invested. Leverage magnifies both gains and losses.
- Past performance, including backtests, forward tests and live track records, is not a reliable indicator of future results. Backtests in particular are affected by modelling assumptions, data quality, spreads, slippage and execution that may differ from live conditions.
- Any figures shown on this site or in demonstrations are illustrative unless expressly stated to be live results, and even live results do not predict future performance.
- We warrant that commissioned software implements the rules in its agreed specification. We do not, and cannot, guarantee that those rules will be profitable.
- You are solely responsible for deciding whether to trade, how much to risk, and for monitoring any automated system you run. Software can fail, connections can drop, brokers can change conditions, and markets can gap.
3. Copy trading
When you follow a strategy or signal provider through a copy-trading service, you take on the provider's risk decisions as your own. Results vary between accounts because of balance, leverage, broker conditions, execution timing and scaling settings. Providers may change their approach or stop trading. You should only follow strategies whose risk you understand and can afford.
4. Crypto-assets and payments
Crypto-assets are volatile and may lose value rapidly; transactions on public blockchains are generally irreversible; and the regulatory treatment of crypto-assets differs by country and may change. Payment gateways we build run in the client's infrastructure with the client's wallets and bank accounts: we do not hold, transmit or control customer funds. Each business using such software is responsible for its own licensing, KYC/AML and tax obligations.
5. Security software
ICEBERG, Privyie and other security products and services are designed to protect information, but no security measure is absolute. We make no guarantee that any system is impenetrable. You remain responsible for your own credentials, devices, PINs and recovery information.
6. Regulatory status
Trading and crypto-asset activities may be restricted or prohibited in your jurisdiction. It is your responsibility to ensure that your use of any software or service we provide is lawful where you are. Our products and services are not directed at persons in any jurisdiction where such direction would be unlawful.
7. Seek advice
If you are unsure whether trading or any product described on this site is suitable for you, seek independent advice from a licensed financial adviser before proceeding.
